NABA PLAYER & TEAM LIABILITY WAIVER & INDEMNIFICATION

READ BEFORE SUBMITTING REGISTRATION - *PLACING A PLAYERS NAME ON THIS ROSTER/WAIVER EFFECTUATES AS A SIGNATURE AND THE WAIVER AS SET FORTH BELOW.

By placing a name on this page, as a player and/or as an individual playing on the team set forth herein or as assigned by NABA league or tournament officials, hereby consent and agree to the following parameters as conditions of participation in the National Adult Baseball Association, Inc.'s (NABA) leagues, and tournaments. I and the team certify that I/We have a valid NABA contract on file with my league president or the NABA National Office and that this is subject to verification. I/We also understand that if the contract is not on file, any league or tournament game I/We participate in will be subject to forfeiture. I and the team certify that I/We are aware of the league and tournament rules and guidelines and NABA rules regarding player conduct and I/We are aware that these rules apply to this league or tournament.

I and the team understand that violation of any part of this contract (and/or the rules contained in the regular season or tournament NABA contract) can result in disciplinary action against me or the team, including forfeiture of games, suspension from play, or permanent expulsion from this league and/or NABA events/tournaments. I and the team understand that the NABA reserves the right to refuse any player or team permission to play in any NABA event, including league.

I and the team realize that the total responsibility of any personal injury, accident, illness, disability, death, property damage, lawsuit, legal issues, and/or other occurrence to any person, place or thing, including me and mine, that occurs due to my actions or the actions of others while I am participating in any NABA league game/tournament, and/or other function, is solely mine and the team.

I and the team will not possess or consume any alcoholic beverages or drugs at any time on the playing field, in the dugouts, bleachers, or other areas near or around the playing field, or within on hundred (100) yards of the playing field facility, including, but not limited to, the parking lots of any facility.

I and the team understand that I/We must be able to identify ourselves with a driver's license or other photo ID at any officially scheduled NABA league or tournament game, or I/We will be ineligible to continue in the game. Any substitute for I/We will enter the game under the rules governing player ejection.

In consideration of the foregoing and being allowed to participate in the NABA activities or functions, including, but not limited to, tournaments, this league, its games, practices and meeting, and intending to be legally bound for myself, my heirs, executors and administrators, I and the team do hereby release and discharge the NABA, including but not limited to, the National Organization, its officers, directors, agents, contractors and employees, any city, county and/or state organization or any other governing body that may have jurisdiction over any baseball field or other facility that I and the team might play on, any other owners, lessors or provider of fields or facilities (whether privately held or otherwise), any umpires or umpire organizations, and their respective officers, directors, agents, contractors, employees and other players in the Association, jointly and severally, from any and all liability from personal injury, accident, illness, disability, death, property damage, legal issue, lawsuit or other occurrence which I and the team may suffer in any manner whatsoever arising out of or resulting from my participation in this league or any NABA activity of function held in conjunction therewith; and I expressly assume all risk of my participation in these activities or functions.

I and the team agree that in the event of rain, any Acts of God or forces beyond NABA's control, league and tournament officials may make every reasonable effort to complete the full league/tournament schedule. Alternate schedules, shortened games, reduced numbers of playoff teams or other means may be used to attempt to complete the league/tournament play. I and the team hereby acknowledge and agree that neither the NABA nor its agents may be held liable for games which cannot be played for reasons as described herein. I and the team know that once I/We submit this official roster that I/We accept these terms and conditions for the players on this roster and as manager of the team. I and the team further agree to explain these terms and conditions to the players on my team who have agreed to participate in the tournament or league play.

I and the team agree that all league fees/dues are to be paid in full before the beginning of the season. Team dues/fees are not refundable and the league is not responsible for individual reimbursements.

I and the team, grant San Jose National Adult Baseball Association (SJNABA) the right to use and publish photographs, videos, or other recordings taken during league events in which I may appear. I understand these images may be used for various purposes, including advertising and social media, without any claim on my part for compensation. I waive any right to inspect or approve the finished product and release SJNABA from any liability related to the use of these images, including any alteration that may occur in their processing. This consent is perpetual and can only be revoked in writing with mutual agreement.

I opt-in to receiving email, text message, direct messages via social media, phone calls, or any other means of communications from the SJ NABA management team and its coaches. 

ACKNOWLEDGMENT & AGREEMENT
I acknowledge and agree with the terms and conditions for which payment is being made to the National Adult Baseball Association; and, furthermore acknowledge and agree to the policies, rules and procedures of the National Adult Baseball Association Signature: I/We have read, understand and agree to comply with the Participant Release and Waiver of Liability as outlined above.

I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing.

I further acknowledge that San Jose NABA has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.

I further acknowledge that San Jose NABA can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others.

I voluntarily seek involvement with the baseball league San Jose NABA and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending any league event.

Before arriving to any San Jose NABA events, I attest that:

1) I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.

2) I have not traveled internationally within the last 14 days.

3) I have not traveled to a highly impacted area within the United States of America in the last 14 days.

4) I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.

5) I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as noncontagious by state or local public health authorities.

6) I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.

I hereby release and agree to hold San Jose NABA harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the league, or that may otherwise arise in any way in connection with anything affiliated with San Jose NABA. I understand that this release discharges San Jose NABA from any liability or claim that I, my heirs, or any personal representatives may have against the league with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any events attended or participated in coordinated by San Jose NABA. This liability waiver and release extends to the league together with all owners, partners, and employees.
